Merger of ASP cadre in to PS Gr. B cadre.....updates from General Secretary.



Meeting regarding merger of ASP cadre into PS Group B cadre was held in the chamber of DDG (Estt) on 28/11/2014. Following were present.

DDG (Estt) welcomed the representatives of the Association and requested for healthy and fruitful discussion to resolve this vital and long pending issue. The proposal submitted by the Association on 20/11/2013 was discussed in detail. Official side expressed their difficulties in implementing the proposal in toto. It was stated by the official side that there are 2106 posts of Inspector Posts and 1990 posts of ASP in the Department. During the course of discussion, it was proposed to upgrade few posts of ASP in Divisional Office into PS Group B cadre in Group A Postal / RMS divisions, CO/RO etc. as well as to retain the Gazetted status of remaining ASPs in their personal capacity till their retirement / promotion in case of merger of IP cadre and ASP cadre into a single cadre. Inspector, Posts will get Grade Pay of Rs. 4600/- after merger at par with Inspectors in CBDT/CBEC as per our demand. Meeting was held in a cordial atmosphere.

In view of the discussions held in the meeting, official side desired a fresh proposal from the Association. The same will be submitted very soon.

Updates on Adhoc ASP Promotion and MACP.

1. It is learnt that action is initiated  in the CO to process the adhoc promotion for senior IPs.  Exact number of vacancies is yet to be arrived since RO Hyderabad has not supplied the required inputs.

2. MACP promotion file is under process. Details will be put in the blog soon after release of DPC proceedings.

Age before duty: Babus to retire at 58 instead of 60



In a move that would help curb the relentless increase in the Centre’s non-Plan spending and ease the way for infusion of more young blood and professionalism into the country’s largely moribund bureaucracy, the Narendra Modi government is planning to reduce the retirement age of central government employees from the present 60 to 58.
The move that comes at a time when the Seventh Pay Commission is mulling another sharp boost to the pay structure of the Centre’s 5-million-strong workforce is also aimed at creating the requisite space for lateral entry of technically qualified professionals into the government, official sources told FE.

The retirement age was last revised in 1998, when the then NDA government led by Atal Bihari Vajpayee raised it from 58 to 60 years. The last UPA government had reportedly considered enhancing the retirement age further to 62 just before the general elections, but dropped the move.

The superannuation age was increased from 55 to 58 way back in 1962.

The total wage and salaries bill of the central government, excluding PSUs but including the railways, rose sharply between 2008 and 2010 due to the revised pay scales (along with payment of arrears) implemented as per the Sixth Pay Commission’s proposals.

The wage bill rose from Rs 1.09 lakh crore in 2007-08 to Rs 1.4 lakh crore in 2008-09, and further to Rs 1.7 lakh crore in 2009-10, before the growth moderated to Rs 1.84 lakh crore in 2010-11. The government spent Rs 2.54 lakh crore in wages and salaries in 2013-14. The railways (with 1.4 million employees), defence (civil), home affairs, India Post and revenue account for more than 80% of the total spending of the Centre on pays and allowances.

Thanks to successive pay commissions, the salaries and other emoluments of government employees have, on average, more than doubled in every decade since independence even though lack of sufficient performance incentives is still considered to be a drawback.

A merger of 50% of the dearness allowance with the basic salary, likely to be part of the Seventh Pay Commission’s award, which is to implemented from 2016, is expected to hike the Centre’s wage bill by a third and strain its fiscal situation. In February this year, the government hiked DA to 100%, from 90%, benefiting both its employees and 3 million pensioners.

The Centre’s expenditure on pension stood at Rs 74,076 crore in 2013-14 and the estimate for the current fiscal is Rs 81,983 crore. However, growth in the outgo on pension is expected to moderate due to the National Pension System based on the concept of defined contribution, launched in January 2004. The NPS has been accepted by large sections of central government employees and most state governments have shifted their employees to the new system.

According to Madan Sabnavis, chief economist at CARE Ratings, reducing the retirement age will give the government an opportunity to outsource more jobs, including by bringing in people as temporary consultants, who will then have to be paid only a fixed salary but not pension or provident fund. Their salary component will then show up as administrative costs, rather than as wage bill.

The finance ministry is weighing the pros and cons of the proposal to cut the retirement age. The move, sources said, is also in line with the BJP’s manifesto, which had promised to rationalise and converge ministries, departments and other arms of the government, open up government to draw expertise from industry, academia and society and tap the services of the youth in particular to contribute to governance.

EXAM IS NOT BAR FOR MACP- High court.

Delhi High court gave judgement stating that examination is not a bar for MACP vide judgement pronounced in WP(C) 4131/2014 dated 05.08.2014. This is another favourable judgement after Jodhpur CAT orders.  All the IPs/ASPs who have the similar issue may please represent to Circle office.  Copy of judgement will be forwarded to  who need it.

OFFICE MEMORANDUM

Subject: Central Civil Service (Classification, Control and Appeal) Rules, 1965 —
 Instruction regarding
timely review of suspension.

Rule 10 of the Central Civil Services (Classification, Control and Appeal) Rules, 1965, deals with the provisions of suspension. As per the rule, a Government servant may be placed under suspension, in the following
 circumstances:

(a) where a disciplinary proceeding against him is contemplated or is pending; or
(b) where, in the opinion of the authority aforesaid, he has engaged himself in activities prejudicial to
 the interest of the security of the State; or
(c) where a case against him in respect of any criminal offence is under investigation, inquiry or trial:

2. A Disciplinary Authority may also consider it appropriate to place a Government servant under 
suspension in the following circumstances. These are only intended for guidance and should not be taken as mandatory:-

(i) Cases where continuance in office of the Government servant will prejudice the investigation, trial 
or any inquiry (e.g. apprehended tampering with witnesses or documents);
(ii) where the continuance in office of the Government servant is likely to seriously subvert discipline in the 
office in which the public servant is working;
(iii) where the continuance in office of the Government servant will be against the wider public interest
 [other than those covered by (i) and (ii)] such as there is public scandal and it is necessary to place the
 Government servant under suspension to demonstrate the policy of the Government to deal strictly
 with officers involved in such scandals, particularly corruption;
(iv) where allegations have been made against the Government servant and preliminary inquiry has
 revealed that a prima facie case is made out which would justify his prosecution or is being proceeded 
against in departmental proceedings, and where the proceedings are likely to end in his conviction and/or
 dismissal, removal or compulsory retirement from service.

3. In the first three circumstances the Disciplinary Authority may exercise his discretion to place a
 Government servant under suspension even when the case is under investigation and before a prima facie
 case has been established. Suspension may be desirable in the circumstances indicated below:-

(i) any offence or conduct involving moral turpitude;
(ii) corruption, embezzlement or misappropriation of Government money, possession of disproportionate
 assets, misuse of official powers for personal gain;

(iii) serious negligence and dereliction of duty resulting in considerable loss to Government
(iv) desertion of duty;
(v) refusal or deliberate failure to carry out written orders of superior officers In respect of the types 
of misdemeanor specified in sub-clauses (iii) and
(v) discretion has to be exercised with care.

3. Rules 10(6) and 10(7) of the CCS (CCA) Rules, 1965, deal with review of the suspension cases. The 
provision for review within ninety day is applicable to all types of suspensions. However, in cases of 
continued detention, the review becomes a mere formality with no consequences as a Government
 servant in such a situation has to continue to be under deemed suspension. A review of suspension is
 not necessary in such cases.

4. It has been brought to the notice of this Department that in cases of prolonged suspension period,
 the courts have pointed out that the suspension cannot be continued for long and that inspite of the
 instructions of DoP&T, the Disciplinary Authorities are not finalizing the disciplinary proceedings within 
the stipulated time. Also, in such cases the Government is unnecessarily paying subsistence allowance 
without extracting any work and if, on the culmination of the disciplinary proceedings, the charged officer is exonerated from the charges, the Government has to unnecessarily pay the full salary and treat the period of suspension as on duty etc.. It is, therefore, desirable that timely review of suspension is conducted in a just
 and proper manner and that the disciplinary proceedings are finalized expeditiously.

5. All Ministries/ Departments are requested to bring the existing instructions on timely review of
 suspension and expeditious completion of disciplinary proceedings to the notice all concerned under
 their control.

Aadhar Based Bio-Metric Attendance System for all Central Govt Employees before 26.1.2015

Sub: Introduction of AADHAR Enabled Bio-metric Attendance System

It has been decided to use an AADHAR Enabled Bio-metric Attendance System (AEBAS) in all offices of the Central Government, including attached/ sub-ordinate Offices, in India. The system will be installed in the offices located in Delhi/ New Delhi by 31st December 2014. In other places this may be installed by 26th January 2015.

2. The equipment will be procured by the Ministries/ Departments as per specifications of DeitY on DGS&D Rate Contract from authorized vendors. The expenditure will be met by the Ministries/ Departments concerned under their O.E. The manual system of attendance may be phased out accordingly.

3. The Department of Electronics and Information Technology (DeitY) will provide the technical guidance for installing the system. The equipment already procured by DeitY have a built in AMC of three years. The Ministries/ departments may ensure that the equipment being procured by them have similar provision.

4. Biometric attendance system is only an enabling platform. There is no change in the instructions relating to office hours, late attendance etc. which will continue to apply. As per extant instructions, (contained in DoPT O.M. No: 28034/8/75- Estt-A dated 04-07-1975; No:28034/10/75-Estt-A dated 27-08-1975; No: 28034/3/82 —Estt-A dated 05-03-1982) half—a-day’s Casual Leave should be debited for each day of late attendance, but late attendance up to an hour, on not more than two occasions in a month, and for justifiable reasons may be condoned by the competent authority. In addition to debiting Casual Leave (or Earned Leave, when no CL is available).Disciplinary action may also be taken against government servants who are habitually late. Early leaving is also to be treated in the same manner as late coming.

5. These orders come into force with immediate effect.

6. All Ministries/ Departments are requested to bring this to the notice of all concerned.

CWC MEETING HELD AT BHADRACHALAM.

Dear members,

We are happy to inform that CWC Meeting was held at Bhadrachalam on 16.11.2014 as notified by the association.  As many as 24 members have took part. the  following important issues were discussed.

1. Grade issue of IPs,
2. Restructuring of IP/ASP cadre in the department,
3. Regular promotions to PS group "B"
4. Other important issues.

Discussed important issues pending in the circle and members advised the committee to focus the same before the administration .  Proceedings of the meeting are being issued shortly. Next CWC is proposed to be held in Kurnool Region ( Place is yet to be decided)

Inclusion of eligible officers who are due to retire before the likely date of vacancies, in the panel for promotion

Subject: – Inclusion of eligible officers who are due to retire before the likely date of vacancies, in the panel for promotion-Regarding.


The undersigned is directed to invite reference to the Department of Personnel and Training Office Memorandum No. 2201114/98-Estt(D) dated October 12, 1998 regarding consideration of retired employees who were within the zone of consideration in the relevant year(s) but are not actually in service when the DPC is being held. The said OM provides as follows:

“……..There is no specific bar in the aforesaid Office Memorandum dated April 10, 1989 or any other related instructions of the Department of Personnel and Training for consideration of retired employees, while preparing year-wise panel(s), who were within the zone of consideration in the relevant year(s). According to legal opinion also it would not be in order if eligible employees, who were within the zone of consideration for the relevant year(s) but are not actually in service when the DPC is being held, are not considered while preparing year-wise zone of consideration/panel and, consequently, their juniors are considered (in their places), who would not have been in the zone of consideration if the DPC(s) had been held in time. This is considered imperative to identify the correct zone of consideration for relevant Year(s). Names of the retired officials may also be included in the panel(s). Such retired officials would, however, have no right for actual promotion. The DPC(s) may, if need be, prepare extended panel(s) following the principles prescribed in the Department of Personnel and Training Office Memorandum No.22011/8/87-Estt.(D) dated April 9, 1996.”

2. Appointment Committee of Cabinet has observed that DPCs often do not consider such eligible officers who are retiring before the occurrence of the vacancy in the panel year. These undesirable trends negate the very purpose of the above said Office Memorandum No. 22011/4/98-Estt(D) dated October 12, 1998 and it is also against the principle of natural justice.

3. All the Ministries/Departments are therefore advised to ensure strict compliance of the instructions of the Department of Personnel & Training issued vide this Department’s OM No. 22011/4/98-Estt(D) dated October 12, 1998.

4. These instructions may please be brought out to the notice of all concerned including attached and subordinate offices.

Grant of honorarium to IO/PO- clarification.

Good news to IPs/ASPs worked as IO/POs.

The ministry of personnel, public grievance and pensions department of personnel & training vide their letter no. 142/15/2010-AVD.I dated 23rd June,2014 clarified that the honorarium payable to the IO/PO for conducting inquiry in departmental proceedings would be outside the purview of the general delegation under FR 46-B. The  directorate  has circulated the same vide memo no. 43-32/2013-PE-II dated 3rd November-2014.

Hence all the IPs/ASPs who worked as IO/PO may request the ROs for clearance of  the pending honorarium.

Secondly, present status of the case also not communicated to this Association.

          It is therefore again and again requested to convey the approval of granting of Non Functional Grade Pay of 5400/- to all the ASP/PS Group B officers effective from the date they have completed 4 years regular service in Grade Pay of 4800/- at the earliest.

(a) CAT case filed at Hyderabad Bench i/c/w to grant GP of Rs.5400/- after completion of 4 years in GP of Rs. 4800/-.

All are aware that 15 Gr. B Officers and ASPs who have completed 4 years of service in Grade Pay of Rs. 4800/- of Andhra Pradesh Circle has already filed OA No. 296 in Hon'ble CAT Hyderabad Bench on 17/3/2014. The applicants have stated in their OA that when a Gr. B officer completes four years of regular service in the GP of Rs. 4800/- is eligible to get GP of Rs.5400/-. While so, the applicants are holding Gr. B gazette post (Offg. PS Gr. B and ASP cadre) and completed 4 years of regular service in the GP of Rs. 4800/- and they are now eligible for financial upgradation in the GP of Rs. 5400/-. 

 Applicants are requested to intimate the present position of case to CHQ. 

(b) CAT case filed at Madras Bench i/c/w to grant GP of Rs.5400/- after completion of 4 years in GP of Rs. 4800/-.

Shri M. Mohanarangam, Ex-GS of All India Association of ASRM and IRM and now Superintendent, NSH, Varanashi has already filed OA in Hon’ble CAT Madras Bench in connection with to grant (MACP) financial up-gradation to applicant in the GP of Rs. 5400/- in PB-2 on non-functional basis, on completion of 4 years of regular service in the GP of Rs. 4800/- w.e.f. 1/9/2008, with all attendant benefits is listed for filing of reply by respondent i.e. Department 

The applicant in his OA No. 1273/2013 stated that 6CPC introduced Modified Assured Career Progression Schemes (MACPs) and the commission recommended that a Gr. B officer in PB-2 with GP of Rs. 4800/- will get the GP of Rs. 5400/- after completing 4 years of regular service on non-functional basis. The recommendations of the 6CPC was accepted by the Government vide GOI, Ministry of Finance’s Resolution dated 29/8/2008.  

The applicant has further stated in his OA that when a Gr. B officer completes four years of regular service in the GP of Rs. 4800/- is eligible to get GP of Rs.5400/-. While so, the applicant is holding Gr. B gazette post (ASP cadre) and completed 4 years of regular service in the GP of Rs. 4800/- and he is now eligible for financial upgradation in the GP of Rs. 5400/- w.e.f.1/9/2012. The applicant while working as ASP (Gr. B) was granted financial upgradation in the GP of Rs. 4800/- in the pay band of Rs. 9300-34800 in PB-2 w.e.f. 1/9/2008.

'SRAMDAN' was conducted by Sri TCS Reddy SSRM Hyderabad sorting division and his office staff in  the premises of Divisional office located at Kacheguda Hyderabad -27, under "Swatch Bharat " launched by the union government of India. Office and premises were kept neat and tidy.


Dos and don'ts for Diabetics


India is known today as the Diabetes capital. It is a matter of increasing concern as 1 in 5 people today is predisposed to diabetes due to their lifestyle.

There are namely two types of diabetes ; Type 1 Diabetes ( Insulin dependent) and Type 2 Diabetes (Weight Management dependent).

Type 2 Diabetes is a dreaded medical condition described by elevated fasting sugar or post prandial sugar levels which could lead to secondary complications in other organs such as the heart, kidney, foot and eyes.

On World Diabetes Day, we tell you how diet and weight management can help control and maintain normal sugar levels.

Listed below are few essential guidelines for Diabetics.

- Eating at regular intervals helps keep the sugar levels consistent and avoids hypoglycemia.

- Replacing simple carbohydrates such as ( rice, white bread, white pasta, maida) with complex carbohydrates such as oats, bajra, jowar, ragi and wheat would help avoid rise in the sugar levels.

- Opt for a low-carb meal consisting of roti, vegetable, salad, egg whites or skim paneer instead of a full meal which includes roti, rice, dal, vegetable and salad at one time.

- It is advisable to eat either one portion of protein (skim milk products, chicken, fish, egg whites) and a portion of fibre (vegetables, fruits, salads) or Omega 3 fats (fish, flaxseeds, walnuts) in each meal to help accelerate metabolism and promote fat loss and thereby effective sugar control.

- It is important to incorporate exercise into daily lifestyle (5 days of walking for 45 minutes) to maintain sugar levels and induce fat loss and maintain levels.

- 1 tsp methi seeds, soaked okra water, 1 tsp cinnamon and 1 glass dudhi karela juice are few home remedies which are known to control diabetes.

Issue of revised Recruitment Rules of PS Gr. B cadre . updates.


All are well aware that Department has created Postmaster Cadre vide memo No. 4-17/2008-SPB.II dated 22/11/2010, and 116 PS Gr. B Posts were carved out for Senior Postmaster Cadre and framed RRs for Senior Postmaster Cadre vide memo No. 137-03/2009-SPB.II dated 9/9/2010.  Since last two years GS is pursing the issue of revised Recruitment Rules of PS Gr. B cadre with Directorate to correct the anomaly of fixation of quota for PS Gr. B from IP Line Officials and General Line Officials by providing 97% vacancies to PS Gr. B from IP Line and 3% by promotion of HSG-I officials from General Line through a LDCE. But till this date neither Recruitment Rules of PS Gr. B cadre revised nor share of General Line officials reduced from PS Gr. B examination. To reduce the quota of General Line officials from LDCE for the promotion to the cadre of PS Gr. B, GS is always in touch with Directorate and now he was told that  Directorate has submitted draft copy of revised Recruitment Rules of PS Gr.B for approval to DoPT.
